Update on Federal Lawsuit: Kids vs the U.S. Government

Written by  Valerie Serrels iMatter Kids

After waiting over a year for the decision of U.S. District Court Judge Wilkins on our motion to reconsider his judgment of dismissal, iMatter youth plaintiffs have moved forward with their appeal to the U.S. Court of Appeals in Washington, D.C. Attorneys filed their opening briefs on October 22nd.

Then, on November 12th, seven different amicus briefs were filed from national security and political figures, to religious groups, scholars, and scientists, and faith-based, native, and social justice/conservation groups. These individuals and groups support the rights of youth to compel our governments to reduce greenhouse gas emissions now. I encourage you to read these fascinating amicus briefs on our partner's, Our Children's Trust, federal lawsuit update page.
This case is the first of its kind to include the atmosphere as part of the public trust doctrine. Many legal scholars, and even the federal judge who dismissed the case, have said the lawsuit raises fundamental questions about the nature of our democracy and our Constitution. The case has been supported by more than twenty prominent environmental and Constitutional law scholars from across the country and noted international climate scientists.  Our attorneys will file two more briefs and responses in December and January and then we wait for the oral arguments sometime in Spring of 2014.

Furthermore, in Pennsylvania, Ashley Funk's petition for rulemaking has not been denied.  The PA Environmental Quality Board has asked for an analysis and a proposal for a plan for 6%/year reductions in CO2 emissions.

It is such an honor to work with these kids, these lawyers, and all of you.

Could This Tax on Wall Street Turn Back America’s Tide of Inequality?

How will you honor the legacy of Martin Luther King Jr. this April 4, the anniversary of his assassination? How about by demanding that Congress get out of Wall Street’s pocket? How about by letting your representative know that you support economic equality and a just distribution of wealth in America? As Dr. King himself said, “This is America’s opportunity to help bridge the gulf between the haves and the have-nots. The question is whether America will do it. There is nothing new about poverty. What is new is that we now have the techniques and the resources to get rid of poverty. The real question is whether we have the will.”

Simply put, the big idea behind the Robin Hood Tax is to generate hundreds of billions of dollars.  That money could provide funding for jobs to kickstart the economy and get America back on its feet. It could help save the social safety net here and around the world.  And it will come from fairer taxation of the financial sector.
